FATWA-FATWA DEWAN SYARIAH NASIONAL MAJELIS ULAMA INDONESIA (DSN-MUI) DAN ASPEK HUKUM ISLAM
Abstract
This study explores the legal status and practical role of the fatwas issued by the National Sharia Council (DSN-MUI) in supporting the development of Islamic economics in Indonesia. Using a normative qualitative approach through literature analysis, the study examines how DSN-MUI fatwas guide Islamic financial institutions in performing transactions in compliance with sharia principles. The results indicate that although DSN-MUI fatwas do not hold binding legal power within the national legal system, they serve as strong moral and religious guidelines, often adopted into formal regulations such as Bank Indonesia Regulations. The study finds that the alignment between DSN-MUI fatwas and national regulations has contributed significantly to legal certainty in sharia-based economic practices. However, challenges such as low public literacy, regulatory gaps, and limited qualified human resources continue to hinder optimal implementation. This research affirms that DSN-MUI fatwas are not merely religious opinions but essential instruments for integrating Islamic values into national economic development.
