Etichal Clearance Policy

Ethical Clearance Policy

Bertuah: Jurnal Syariah dan Ekonomi Islam

A. Policy Statement

Bertuah: Jurnal Syariah dan Ekonomi Islam is committed to upholding research integrity, ethical responsibility, and transparency throughout the research and publication process.

The journal requires authors to ensure that research submitted for publication has been conducted in accordance with applicable laws and regulations, institutional requirements, and recognized ethical standards relevant to the research design and discipline.

This policy establishes the journal's requirements concerning ethical approval, informed consent, participant protection, confidentiality, and the responsible use of research data. It is intended to protect the rights, dignity, privacy, safety, and welfare of research participants while promoting accountability in scholarly research.

The journal applies a proportionate approach to ethical oversight. The need for formal ethical approval is determined by the nature of the research, the involvement of human participants or identifiable private information, the potential risks associated with the study, and applicable institutional and regulatory requirements.

B. Scope and Ethical Principles

This policy applies to all manuscripts submitted to the journal, including empirical studies, qualitative research, quantitative research, surveys, interviews, field studies, documentary research, literature reviews, conceptual studies, and normative or doctrinal studies in Islamic law and Islamic economics.

The journal recognizes the importance of the following principles:

  1. Respect for human dignity and autonomy: Research participants must be treated with respect, and their rights and choices must be protected.

  2. Justice and fairness: The selection and treatment of research participants must be fair, without unjustified discrimination, coercion, or exploitation.

  3. Beneficence and non-maleficence: Researchers should seek to maximize the potential benefits of research while minimizing foreseeable harm.

  4. Privacy and confidentiality: Personal information and confidential research data must be protected through appropriate safeguards.

  5. Research integrity and accountability: Research must be conducted and reported honestly, transparently, and responsibly.

  6. Islamic ethical values: The journal recognizes amanah (trustworthiness), 'adl (justice), maslahah (public welfare), and respect for human dignity as relevant ethical considerations in research concerning Sharia and Islamic economics.

These principles complement, rather than replace, applicable legal requirements and recognized research ethics standards.

C. Research Requiring Ethical Approval

Authors must obtain approval from an appropriate research ethics committee, institutional review board, or other competent ethics-review body before commencing research activities that require formal ethical review under applicable regulations or institutional policies.

Research that may require ethical approval includes, but is not limited to:

  1. Surveys, interviews, focus group discussions, and other studies involving human participants where formal review is required.

  2. Research involving vulnerable individuals or groups, including minors and individuals who may be subject to coercion, dependency, or social or economic disadvantage.

  3. Studies involving sensitive personal information, confidential financial records, or identifiable non-public data.

  4. Research that may expose participants to psychological, social, economic, reputational, legal, or other foreseeable harm.

  5. Research involving interventions, experimental procedures, or other activities subject to formal ethics review.

  6. Other research activities for which approval is required by the relevant institution or applicable law.

Where approval is required, authors must obtain it before commencing the relevant research activities. Authors must not represent retrospective approval as prior approval.

The journal may request documentation confirming the approval and may assess whether the approval is relevant to the research reported in the manuscript.

D. Informed Consent and Participant Protection

Authors must obtain informed consent from research participants whenever required by applicable ethical standards and institutional or regulatory requirements.

Participants should receive appropriate information about the research objectives, procedures, foreseeable risks, potential benefits, confidentiality arrangements, and intended use of the information collected. Participation must be voluntary, and appropriate safeguards must be established to prevent coercion or undue influence.

When research involves minors or individuals who cannot provide legally or ethically valid consent independently, researchers must follow applicable requirements concerning parental permission, legally authorized representatives, assent, and additional participant protections.

Authors must take appropriate measures to protect personal information and confidential data. Identifying details must not be disclosed in a publication without an appropriate legal and ethical basis and consent where required.

When an article contains identifiable personal information, images, quotations, or case descriptions that could reasonably reveal an individual's identity, authors must ensure that the necessary permission for publication has been obtained where required.

The journal may request an explanation of consent procedures and supporting documentation. To protect participant confidentiality, authors should not upload identifiable consent forms to the manuscript system unless specifically requested through an appropriate secure procedure.

E. Research Not Requiring Formal Ethical Review

Formal ethical approval is ordinarily not required for research that does not involve human participants, identifiable private information, or other activities subject to formal ethics review, provided that the applicable institutional and regulatory requirements do not establish otherwise.

Examples may include:

  1. Normative or doctrinal studies based on the Qur'an, Hadith, classical and contemporary fiqh literature, fatwas, legal doctrines, and other published scholarly sources.

  2. Literature reviews and conceptual studies based exclusively on published academic literature.

  3. Analysis of publicly available legislation, institutional policies, published fatwas, annual reports, and other public documents, where no restricted or identifiable private information is involved.

  4. Other forms of documentary or theoretical research that do not present ethical concerns requiring formal review.

The classification of a study as not requiring formal ethical review must be based on its actual methods, data sources, and applicable requirements, rather than solely on the article's title or research category.

When formal approval is not required, authors must provide an appropriate declaration if requested by the journal. The journal may seek clarification or supporting evidence if the ethical status of a study is uncertain.

An exemption from formal ethical review does not exempt authors from complying with applicable privacy, confidentiality, copyright, consent, and research integrity requirements.

F. Ethical Approval Documentation and Manuscript Declarations

For research requiring formal ethical approval, authors must include an ethical approval statement in the manuscript, preferably in a clearly identified section or within the methodology section.

The statement should include, where applicable:

  • The name of the ethics committee or approving institution.

  • The ethical approval reference or protocol number.

  • The date of approval.

  • A statement concerning informed consent.

  • Information about any formal waiver or exemption granted by the competent reviewing body.

Authors must provide an ethical approval letter, certificate, or other appropriate supporting documentation when requested by the editorial team.

If a competent ethics-review body has formally waived the requirement for ethical approval or informed consent, authors must accurately report the waiver and provide supporting documentation when requested.

Where formal ethical review was not required, authors should provide a brief explanation of the basis for that determination when requested.

The journal reserves the right to request additional information when the documentation or declaration is incomplete, inconsistent, or insufficient to establish compliance.

G. Responsibilities of Authors and Editors

Responsibilities of Authors

Authors are responsible for:

  1. Identifying and complying with the ethical requirements applicable to their research.

  2. Obtaining necessary ethical approval before commencing research activities that require such approval.

  3. Securing informed consent and protecting participants where applicable.

  4. Ensuring the accuracy and authenticity of ethical approval documents and declarations.

  5. Protecting personal information and maintaining confidentiality.

  6. Disclosing relevant ethical concerns and cooperating with editorial inquiries.

  7. Correctly reporting approval, waiver, exemption, and consent arrangements in the manuscript.

Responsibilities of Editors

The editor-in-chief and editorial team are responsible for:

  1. Assessing the ethical information provided during manuscript screening.

  2. Requesting additional documentation or clarification when necessary.

  3. Determining whether a manuscript satisfies the journal's ethical requirements.

  4. Seeking advice from an appropriate ethics-review body or institutional authority when necessary.

  5. Maintaining the confidentiality of ethical documentation and sensitive participant information.

  6. Addressing suspected ethical misconduct in accordance with the journal's publication ethics procedures and relevant guidance.

Ethical approval from an external institution does not prevent the journal from assessing whether the reported research appears ethically acceptable.

H. Non-Compliance and Ethical Misconduct

The journal may return a manuscript for clarification, suspend editorial processing, or reject it if required ethical approval, consent arrangements, or supporting documentation are missing or insufficient.

Suspected fabrication or falsification of ethical approval, misrepresentation of consent, unauthorized disclosure of confidential information, or other serious ethical violations will be assessed through an appropriate editorial process.

Where necessary, the journal may contact the relevant institution or ethics-review body, subject to applicable confidentiality and legal requirements.

If serious ethical concerns are identified after publication, the journal may publish a correction, an expression of concern, or a retraction, depending on the nature and severity of the issue and the available evidence.

Editorial decisions must be proportionate to the circumstances and consistent with the journal's established publication ethics procedures.

I. Policy Implementation and Review

This policy applies to all authors submitting manuscripts to Bertuah: Jurnal Syariah dan Ekonomi Islam.

Authors are encouraged to consult their institutions or appropriate ethics-review bodies before commencing research whenever the ethical requirements are uncertain.

The journal may revise this policy to reflect changes in applicable laws, institutional requirements, research ethics standards, and recognized scholarly publishing practices.

The editorial team is responsible for implementing this policy consistently and transparently.
